Terms of Service

1. Acceptance of Terms

By accessing and using Homi ("the Service"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users, including property seekers, realtors, and visitors, and to both the Homi mobile app and the Homi website.

2. Description of Service

Homi is a real estate platform that connects property seekers with realtors through video tours. Our service includes property discovery, video listings, user profiles, property inquiries, and communication features. Homi facilitates connections between users but is not a party to any real estate transactions.

3. User Accounts

You must be at least 13 years old to create an account. If you are under 18, you may use the Service only with the involvement and consent of a parent or legal guardian, and only they may enter into a rental agreement. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You must notify us immediately of any unauthorized use of your account.

4. User Responsibilities

As a user, you agree to:

  • Use the Service only for lawful purposes
  • Not post false, misleading, or fraudulent property information
  • Not harass, abuse, or harm other users
  • Not interfere with or disrupt the Service
  • Not use automated systems to access the Service without permission
  • Comply with all applicable laws and regulations

5. Content Guidelines

Users are solely responsible for the content they upload, including property listings, videos, photos, and messages. All content must be accurate, legal, and appropriate. Prohibited content includes: false or misleading information, illegal content, spam, content that violates others' rights, or content that is discriminatory or harmful. We reserve the right to remove, edit, or refuse any content that violates these guidelines.

6. Objectionable Content, Reporting, and Blocking

We have no tolerance for objectionable content or abusive users. Objectionable content includes anything unlawful, discriminatory, harassing, hateful, threatening, sexually explicit, violent, fraudulent, or impersonating another person, and any listing for a property that does not exist or that the poster has no right to list.

Every listing and every user profile in the app carries a report control. Reports come to us directly. We review every report and aim to act within 24 hours, removing content and ejecting the users who posted it, without notice and at our sole discretion.

You can also block any user from their profile or from one of their listings. Blocking hides that user's listings from your feed and stops them contacting you. Blocked accounts are listed under Profile → Edit Profile → Blocked List, where you can unblock at any time.

If you cannot reach the in-app controls, or a report needs a human urgently, email support@itshomi.com.

7. Fair Housing

Homi supports and abides by the federal Fair Housing Act, the New York State Human Rights Law, and the New York City Human Rights Law. Housing advertised on Homi is available to all persons without regard to race, colour, religion, sex, national origin, familial status, disability, age, sexual orientation, gender identity or expression, marital status, military status, lawful source of income (including housing vouchers and rental assistance), or any other characteristic protected by applicable law.

Listings, descriptions, and messages that state or imply a preference, limitation, or discrimination on any of those bases are prohibited and will be removed. If you post housing on Homi, you are responsible for your own compliance with fair housing law, including in the wording of your listings and in how you respond to enquiries.

If you believe a listing or a user has discriminated against you, report it in the app or email support@itshomi.com. You may also file a complaint with the U.S. Department of Housing and Urban Development at hud.gov/fair-housing or, in New York City, with the NYC Commission on Human Rights at nyc.gov/cchr.

8. Realtor Responsibilities

If you are a realtor posting properties, you represent that you have the legal right to list such properties and that all information provided is accurate. You are responsible for all interactions with property seekers and for any real estate transactions that may result from your listings. Homi is not responsible for the accuracy of property information or the outcome of any transactions.

9. Privacy Policy

Your privacy is important to us. Our Privacy Policy describes how we collect, use, and protect your information. By using the Service, you consent to the collection and use of your information as described in our Privacy Policy, which is incorporated into these Terms by reference.

10. Intellectual Property

The Service and its original content, features, and functionality are owned by Homi and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our express written permission. You retain ownership of content you upload but grant us a license to use, display, and distribute such content on the Service.

11. Copyright and DMCA

Homi respects copyright, and we remove infringing material. If you believe content on the Service infringes a copyright you own or represent, send a notice to support@itshomi.com including: your physical or electronic signature; identification of the copyrighted work you claim has been infringed; identification of the material you claim is infringing, with enough detail for us to find it; your contact details; a statement that you have a good-faith belief the use is not authorised by the copyright owner, its agent, or the law; and a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on their behalf.

We terminate the accounts of repeat infringers. If you believe your content was removed in error, you may send a counter-notice to the same address.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee the accuracy, completeness, or reliability of any property information, listings, or user content. We are not a real estate broker, agent, or transaction facilitator. We do not verify property information or user identities. You use the Service at your own risk.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Homi AND ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR ANY REAL ESTATE TRANSACTIONS.

14. Indemnification

You agree to indemnify, defend, and hold harmless Homi and its officers, directors, employees, and agents from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of or related to: the content you post; your use of the Service; your breach of these Terms or of any law; your violation of anyone else's rights; or any tenancy, lease, or real estate transaction arising from a connection made through the Service.

15. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. You may delete your account at any time in the app under Profile → Edit Profile → Delete Account. Upon termination, your right to use the Service will cease immediately, but provisions that by their nature should survive will remain in effect.

16. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict of law provisions. Any dispute arising out of these Terms or the Service shall be brought exclusively in the state or federal courts located in New York County, New York, and you consent to the personal jurisdiction of those courts.

17. Apple App Store

The following applies when you download the Homi app from the Apple App Store:

  • These Terms are between you and Homi only, not with Apple, and Homi alone is responsible for the app and its content.
  • Apple has no obligation to provide any maintenance or support for the app.
  • If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
  • Apple is not responsible for addressing any claim by you or a third party relating to the app, including product liability claims, any claim that the app fails to conform to a legal requirement, and claims arising under consumer protection or similar legislation.
  • Apple is not responsible for investigating, defending, settling, or discharging any third-party claim that the app infringes intellectual property rights.
  • You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

18. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect, such as through the app or by email. What constitutes a material change will be determined at our sole discretion. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
